Terms of Service

Welcome to Break The Web Technology Co. (“Break The Web,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our AI-powered services, including chatbot interfaces, applications, and related technologies (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Overview of Service

The Service uses large language models (“LLMs”) and other AI technologies to generate content based on user input. Outputs are automatically generated and may be inaccurate, incomplete, offensive, misleading, or otherwise inappropriate. You acknowledge and agree that all Outputs are provided “as is” and “as available,” without guarantees of quality, accuracy, or suitability.

2. No Professional Advice

The Service does not constitute and is not a substitute for professional advice, including but not limited to medical, legal, financial, or safety-related advice. You acknowledge that you are solely responsible for verifying and relying on any Output, and that you use the Service at your own risk.

3. Eligibility & User Conduct

To use the Service, you must be at least 13 years old (or the age of digital consent in your country) and, if under 18, have the permission of a parent or legal guardian.

You agree not to:

  • Use the Service for any illegal, harmful, fraudulent, or abusive purposes
  • Attempt to exploit, reverse-engineer, or interfere with the functionality of the Service
  • Submit confidential, sensitive, or proprietary information you do not have the right to use
  • Use the Service to generate or disseminate content that violates any applicable law, regulation, or our usage policies

4. User Accounts & Access

To access certain features of the Service, you may be required to create an account—either by registering directly with us or by logging in through a third-party provider (such as Google or Apple). When registering directly, we may collect your name, email address, OpenAI API key (if applicable), and other relevant details. When using a third-party login, you authorize us to access specific account information, as permitted by that provider’s terms and privacy settings.

If you provide an OpenAI API key or other developer credentials, you are responsible for ensuring the accuracy and security of those keys and for all activities conducted using them. Misuse of API integrations may result in account restriction or termination.

You are also responsible for safeguarding your login credentials and for any activity that occurs under your account. We are not liable for losses arising from unauthorized account access.

By registering or logging in, you consent to receive communications from us electronically, including legal notices, service updates, and limited promotional content. You can opt out of promotional communications at any time.

Your use of the Service is also subject to our Privacy Policy, which describes how we handle your data.

Optional Paid Features and Subscriptions:

We may offer optional paid features, plans, or usage tiers that enhance or extend the Service. Payments are securely processed via a third-party payment processor, such as Stripe.

  • You agree to provide accurate and up-to-date billing information and to maintain a valid payment method.
  • We do not store full credit card or financial details on our servers.
  • Fees are non-refundable except where required by law or explicitly stated otherwise.
  • Failure to pay may result in limitation, suspension, or cancellation of access to paid features.

All payments and billing data are subject to Stripe’s terms of service and privacy policy.

Free Trial Access:

If you are using the Service on a free or trial basis (“Free Trial”), you acknowledge and agree to the following additional terms:

  • Free Trial access is provided solely for evaluation or non-commercial use, unless expressly authorized by Break The Web.
  • The Service is offered “as is” and “as available” during the trial period, with no guarantees regarding accuracy, availability, support, or uptime.
  • We may limit, suspend, or terminate your Free Trial access at any time, without notice or liability.
  • To the maximum extent permitted by law, Break The Web disclaims all liability for any damages, losses, or claims arising from or related to your use of the Service during the Free Trial.

We reserve the right to suspend or terminate any account—free or paid—at our sole discretion, including in cases of suspected misuse, impersonation, or violation of these Terms.

5. Input and Output Ownership

  • Your Input: You retain ownership of the content you submit to the Service (“Input”). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, process, and store your Input as necessary to provide and improve the Service.
  • AI Output: Subject to these Terms, you may use the AI-generated content (“Output”) for personal purposes. Commercial use may require a separate agreement or additional licensing from Break The Web. We do not guarantee that Output is unique, accurate, or free from intellectual property issues. You are solely responsible for your use of the Output.

We may use aggregated or anonymized data derived from your Input and use of the Service to improve our models and systems. We do not sell your personal data.

You may not use the Service or any Output to train, fine-tune, or otherwise develop competing AI models or services.

6. Intellectual Property

All rights, title, and interest in and to the Service (excluding your Input), including all software, models, algorithms, interfaces, and content, are owned by Break The Web or its licensors. These Terms do not grant you any ownership rights in the Service or its components.

The Service may contain links to or excerpts from third-party content, such as news sites. All such third-party trademarks and content remain the property of their respective owners, and their inclusion does not imply endorsement or ownership by Break The Web.

7. Beta Features

We may offer early-access or experimental features (“Beta Services”). Beta Services are provided on an “as is” and “as available” basis without warranties. We may modify or discontinue Beta Services at any time without notice.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. YOU ASSUME ALL RISK FOR YOUR USE OF THE SERVICE AND OUTPUT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • BREAK THE WEB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Break The Web, its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Termination does not relieve you of any obligations incurred before termination.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service will be resolved exclusively through final and binding arbitration, except for individual small claims.

The arbitration will be conducted by a single arbitrator through JAMS or AAA under its applicable rules, in San Francisco County, California, unless otherwise agreed. Judgment may be entered in any court with proper jurisdiction.

YOU AND BREAK THE WEB WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Opt-Out

You may opt out of arbitration by sending written notice to support@btw.co within 30 days of first using the Service. Your notice must include your full name and a statement that you wish to opt out.

13. Feedback

If you provide suggestions, comments, or other feedback (“Feedback”), you grant us a perpetual, worldwide, irrevocable, royalty-free license to use it for any purpose, including improving the Service.

14. AI Content Disclosure

You acknowledge that the Service generates responses using artificial intelligence. Outputs may reflect biases, errors, or offensive content and do not represent the views of Break The Web.

15. Export Compliance

You agree to comply with all applicable export control laws and regulations, including U.S. Export Administration Regulations (EAR) and OFAC sanctions. You may not use the Service if you are located in a sanctioned jurisdiction.

16. Reservation of Rights

All rights not expressly granted under these Terms are reserved. Our failure to enforce any provision shall not constitute a waiver.

17. Survival

The provisions of these Terms that should survive termination—including Sections 5, 6, 8, 9, 10, 12, and this Section—shall continue in effect.

18. Changes to These Terms

We may update these Terms at any time. If we make material changes, we’ll notify you through the Service or by email. Continued use of the Service after changes take effect constitutes your acceptance.

19. Force Majeure

We are not liable for failure or delay due to causes beyond our reasonable control, including natural disasters, internet outages, strikes, civil unrest, or third-party service failures.

20. Third-Party Services

The Service may rely on or interact with third-party systems or APIs. We are not responsible for interruptions or limitations caused by such third-party providers.

21. DMCA Copyright Policy

If you believe content on the Service infringes your copyright, send a notice to support@btw.co with:

  • A description of the copyrighted work
  • The location of the infringing material
  • Your name, contact info, and a good-faith statement of unauthorized use
  • A statement under penalty of perjury that your notice is accurate
  • Your physical or electronic signature

We will respond to valid DMCA requests as required by law.

23. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

24. Entire Agreement

These Terms (together with our Privacy Policy) constitute the entire agreement between you and Break The Web regarding your use of the Service and supersede any prior agreements or understandings, whether oral or written.

25. No Agency

Use of the Service does not create any agency, partnership, employment, or joint venture relationship between you and Break The Web.

26. Assignment

We may assign these Terms, in whole or in part, at any time with or without notice. You may not assign your rights under these Terms without our prior written consent.

27. Payments & Subscriptions

Certain features of the Service may be offered on a paid basis. If you elect to purchase a subscription or other paid service, you agree to provide accurate payment information and authorize Break The Web (or its designated third-party payment processor, such as Stripe) to charge applicable fees.

  • Billing: Fees are billed in advance and may be recurring unless stated otherwise. You are responsible for maintaining accurate billing information.
  • Third-Party Processing: All transactions are processed securely by third-party providers. Break The Web does not store or process full payment card details.
  • Refunds: Except where required by law or explicitly stated, all payments are non-refundable.
  • Failure to Pay: We reserve the right to suspend or terminate access to any paid feature for failure to pay applicable fees.

Use of paid services remains subject to these Terms and our Privacy Policy.


EU Terms of Service Addendum
Effective Date: August 2, 2025

This Addendum supplements the Break The Web Terms of Service and applies to individuals located in the European Economic Area (EEA), the United Kingdom (UK), and Switzerland. It ensures compliance with the General Data Protection Regulation (GDPR), the UK GDPR, and other applicable European data protection laws.

By using our Services from within the EEA, UK, or Switzerland, you agree to the terms outlined in both the main Terms of Service and this Addendum.

5. Automated Decision-Making

We do not use automated decision-making in a way that produces legal or significant effects about you. Our AI outputs are informational and do not impact your legal rights or service access.
